CIT Update: IEEPA Refund Process

Judge Eaton just issued a new court order in Atmus Filtration v. United States clarifying that CBP must reliquidate previously liquidated entries to remove IEEPA duties, including entries that have already reached final liquidation. This expansion goes beyond the Court’s March 20 order and makes clear that even entries that would normally be considered closed must now be corrected by CBP. As a result, the protest filing concern we previously highlighted is no longer a major stress factor for importers, since CBP is directed to take action on its own rather than requiring importers to preserve claims through protests. CBP is scheduled to provide an update on the status of CAPE on March 31. This update should offer more insight into the claims process and the expected timing for launch.
